Does The Rustic Dietitian’s privacy policy apply to me?
By accessing or using my services (“Services”), such as accessing or using information on my website located at http://www.therusticdietitian.com (“Site”) or in my e-mailed newsletter, or by downloading or accessing my digital products available on the Site, (“Digital Products”), you accept and agree to the terms of my Privacy Policy. By submitting personal information to my Site to gain access to, purchase, or use my Services, Digital Products, or other features of my Site, such as a promotion, contest, giveaway, or sweepstake on my Site, you accept and agree to the terms of my Privacy Policy and expressly consent to my collection, use, and disclosure of your personal information in accordance with my Privacy Policy.
TRD’s Privacy Policy DOES NOT apply to any information that you submit in a public comment on the Site or to information that you may share on any of TRD’s social media properties, such as information you share in a comment, like or post on TRD’s Facebook page or in comments or likes on TRD’s Instagram posts. You do not have an expectation of privacy in the information you reveal in a public comment on my Site or in your interactions on any of TRD’s social media platforms. I am not responsible for any information that you submit to or via a third party (such as Facebook, when you post to, comment on, or like material on the TRD Facebook Page, for example) or in a public comment on TRD’s Site.
What information does TRD collect?
TRD collects two types of information from you: Personally identifiable information (e.g., information that can be used to identify you specifically, such as your name, e-mail address, billing address, telephone number, credit card information, etc.) and non-personally identifiable information (e.g., information that reasonably could not be linked to or associated with you or aggregated anonymous data, etc.).
Newsletter Subscription: When you subscribe to my newsletter (“Join The Tribe”), I collect the name and e-mail address that you submit and use MailChimp to manage my e-mails and newsletters. You can view their Privacy Policy HERE.
Digital Product Download: When you purchase one of my Digital Products, I collect your name, e-mail address, credit card information, and billing address through PayPal or Stripe. When you purchase a free Digital Product, I only collect your name and e-mail address.
Promotions: If you participate in a TRD promotion like a giveaway, contest, or sweepstake, I collect and store the name and e-mail address you submit to enter the promotion.
Surveys: If you participate in a TRD survey, I may collect your name and e-mail address in connection with that survey, as well as the information you agree to submit in the survey.
Does your site use cookies?
My website uses cookies in order to deliver a better experience for you. For example, if you log in to my site, I may be able to personalize your experience by recognizing your name when you return to the site, save your login and/or password, or enable your shopping cart function. My newsletters and e-mail messages may use cookies to measure the effectiveness of my marketing (e.g., to track clicks on links in my e-mails/newsletters) or I may use cookies to determine the number of times Site visitors have accessed a particular area on the site. Most web browsers have a function that allows you to delete existing cookies on your device or you can set your browser options so that your device does not receive or accept cookies. Third party analytics
I use Google Analytics, which uses cookies and collects aggregate data from my website visitors, such as which areas of my Site receive the most traffic, how often visitors go to a particular page and the duration of their visits, general geographical location information, or the source of referred traffic to my Site (e.g., visits via search engine search or social media, etc.). Google Analytics also collects the IP address assigned to you on the date of your visit. I do not separately aggregate or store your IP address with any of your personal information outside of the data I access in Google Analytics.
What does TRD do with my information?
Non-Personally Identifiable Information
I use non-personally identifiable information, like aggregate data about the most visited Site pages or the duration of a certain Site page’s visits from Google Analytics that is not tied to any specific Site user, to maintain, improve, and protect my Site, my product, and my service offerings.
Personally Identifiable Information
When you sign up for my newsletter (by “Joining The Tribe”), I use the name and e-mail address that you provide to subscribe you to my newsletter, in order to send you the newsletter or e-mails. I store the name and e-mail address you provide in an SSL encrypted database.
When you enter a promotion on my Site, I use the information you submit to administer the promotion (e.g., enter you into the promotion, notify you if you are a winner, and send you your prize). I store the name and e-mail address you provide in an SSL encrypted database. If the prize for the promotion is administered by a third party, I may provide your name and e-mail address to that third party if you are one of the winners of a promotion. Please read the rules of any promotion prior to entering any giveaway, contest, or sweepstakes.
When you purchase a Digital Product, I use the personal information you provide to process the transaction, deliver the purchased Digital Product(s), and to provide customer service as necessary. I store this information in an SSL encrypted database.
What about international transfers?
I am subject to the provisions of the General Data Protection Regulations (GDPR) that protect your personal data. Where I transfer your data to third parties outside of the EEA, I will ensure that certain safeguards are in place to ensure a similar degree of security for your personal data. As such:
I may transfer your personal data to countries that the European Commission have approved as providing an adequate level of protection for personal data by; or
If I use US-based providers that are part of EU-US Privacy Shield, I may transfer data to them, as they have equivalent safeguards in place; or
Where I use certain service providers who are established outside of the EEA, I may use specific contracts or codes of conduct or certification mechanisms approved by the European Commission which give personal data the same protection it has in Europe.
If none of the above safeguards is available, I may request your explicit consent to the specific transfer. You will have the right to withdraw this consent at any time.
Do you link to third party websites?
I sometimes provide links to third party websites on my Site. If you choose to click on a third-party website link on my Site, you acknowledge and agree that TRD has no control over or responsibility for the information, content, products, services, advertising, or information collection practices of the third party site(s). I do not make any representations or warranties regarding the accuracy, security or legal or regulatory compliance of third party websites and you agree to assume the risks, responsibilities, and consequences resulting from your use or access of third party websites.
Does TRD share my personal information with third parties?
There are some instances in which TRD may share your personal information. I may disclose your personal information without your consent when I have a good faith belief that I am required to release the information pursuant to any applicable law, regulation, court order, or legal process.
I may also disclose or use your personal information in order to enforce my Terms of Use and/or Privacy Policy, including disclosure or use to investigate potential violations of my Terms of Use and/or Privacy Policy and to detect, prevent, or address fraud, security, or technical issues.
Do you collect children’s information?
My Site and my Digital Products and Services are not directed to, marketed towards, or intended for children under thirteen (13) years of age and I request that children under 13 do not submit any personally identifiable information or any other information to my Site.
Is my personally identifiable information secure?
The security of your personally identifiable information is important to TRD.
I use a third-party service for payment processing of Digital Products and Services. I do not store or collect your payment card details. That information is provided directly to our third-party payment processor whose use of your personal information is governed by their Privacy Policy. The payment processor I work with is Stripe. All my charting and personal health information collected from clients is stored on PracticeBetter, an EPA compliant web service. You can find their Privacy Policy HERE.
Please remember that no method of transmission over the Internet or method of electronic or physical storage is 100% secure. While I value the privacy and security of your personal information, I cannot guarantee against or prevent potential security breaches, nor can I assure you that the personally identifiable information that you provide to me will never be disclosed in a manner inconsistent with this Privacy Policy.

What are my opt out choices?
Electronic Newsletter and E-mail Communications
You may unsubscribe from my electronic newsletters or e-mail communications (including promotional e-mails) at any time by following the unsubscribe instructions in the e-mail or newsletter you received from me. You can also contact me via e-mail at support@therusticdietitian.com.
Correction or deletion of personally identifiable information.
You may request that I update, change, correct, or delete your personally identifiable information at any time. If you request that I delete your personally identifiable information, I will remove your personally identifiable information that is stored in databases I actively use and in readily searchable formats. Please be aware, however, that it may not be technologically possible for me to erase or otherwise remove every record of the information you have provided to me, such as information stored on backup tapes or backup servers. I am not responsible for and cannot control the personally identifiable information that you have provided to third parties.
California residents.
If you are a resident of California, you have the right to request a list of all third parties to which TRD has disclosed certain personally identifiable information during the preceding year for third party direct marketing purposes. If you choose to make such a request, please be advised that you are limited to one request per calendar year. Please provide a current California address for my response to you and please also attest to the fact that you are a California resident. At this time, I only collect personally identifiable information about your online activities on my Site. I do not collect personally identifiable information about your online activities over time and across third-party web sites or online services.
Does TRD use affiliate links?
Yes. At this time TRD is a participant in the Amazon Services LLC Associates Program. As an Amazon Associate I earn from qualifying purchases. A special tracking code is used and I may make a small commission on the sale of an item if you purchase through one of these links. The price of the item is the same for you whether it is an affiliate link or not.
If I post an affiliate link to a product, it is something that I personally use, support and would recommend without an affiliate link. Unless noted otherwise, any product I link to is one I have purchased myself and use for myself or my family. I do not accept free products for review and also disclose if I am affiliated with a company in any other way that benefits me financially.
Please note that while I personally purchase, review and use every product I link to, these products are purchased from third party companies and I do not control these companies or have a financial interest other than an affiliate relationship unless otherwise disclosed.
For this reason, I cannot ensure that any item purchased through a link on TRD is shipped on time, packaged properly, or that you will like it. Any problems or concerns with a specific product purchased through a link on this website should be directed to the company the item was purchased from.
How will I be notified of changes to the privacy policy?
I may change my Privacy Policy from time to time. When I make a material change to this Policy, I will post the changes on this Privacy Policy web page and may also inform you of the changes by other means, such as in my newsletter or in a direct e-mail containing the update.
